Flanders: omgevingsvergunning
The Flemish authorities explain that works with a spatial impact generally require an omgevingsvergunning. Some smaller works may qualify for an exemption or notification. Local conditions can be stricter, so ask your municipality to assess the proposal for your plot.
Wallonia: permis d’urbanisme
Many building works and the placement of fixed installations require permission in advance. A structure intended to stay in place can be relevant even if it can be dismantled or moved. Check the applicable route and any exemptions with the municipal planning service before starting works.
Brussels: check with the local planning service
The Brussels-Capital Region directs applicants to their municipality and urban.brussels to determine whether a planning permit is needed. Describe the actual works, use and existing situation rather than relying only on the word “modular”.
A care home or intergenerational home?
A kangoeroewoning, a care arrangement and an extra independent dwelling should not be assumed to follow the same rules. Discuss the intended residents, independence of the accommodation, services and future use. Ask the municipality which procedure and housing requirements apply to the specific proposal.
Prepare your first planning discussion
Bring the plot address and plan, photos, existing permits if available, intended use, approximate area, height and position of the proposed building. For an extension or extra floor, include existing drawings. Ask about planning constraints, required studies, the project team and the appropriate application procedure.
